What Landlords Need to Know About the End of the LA Eviction Moratorium

Note: This article was accurate as of December 2022 and many of these rulings still apply in 2023. For a more updated look at eviction moratoriums and extensions across the country, check out the latest post from May 2023. 

The Los Angeles City Council voted 12-0 to end long-standing renter eviction protections due to COVID-19 hardship on Jan. 31, 2023. Beginning February 1, 2023, tenants must pay their full current monthly rent in order to avoid eviction for non-payment of rent. Landlords will be able to resume increasing rent on rent-controlled apartments, which account for three-quarters of apartments in Los Angeles, beginning in February 2024.

Los Angeles County enacted the COVID-19 Tenant Protections Resolution in March 2020 to protect residents from eviction during the pandemic. The resolution prohibited rent increases and evictions due to non-payment related to COVID-19 hardships. In November 2022, the County Board of Supervisors clarified which protections would end in 2023, and which would continue indefinitely. 

Eviction moratoriums have been implemented and modified multiple times over the past two years, and it can be difficult for landlords to keep up with the latest changes and requirements.

Which resident protections end January 31, 2023?

The bulk of the COVID-19 special tenant protections are currently scheduled to expire on January 31st, 2023, including:

Rent increase freeze. This means homeowners will be able to increase rent starting in 2023 in most cases. Homes that have had rent control protections prior to the COVID-19 Resolution will continue to have them. This includes homes under the Los Angeles Rent Stabilization Ordinance as well as those in cities who maintain rent control standards like Santa Monica and West Hollywood. If you are unsure if you are part of the Rent Stabilization Ordinance (RSO) please contact your Belong team.

Protections against evictions for specific circumstances. Under the resolutions, certain residents could not be evicted for non-payment of rent due between July 1, 2022 and December 31, 2022 due to a COVID-19 financial hardship. They could not be evicted in a No-Fault eviction unless the eviction was due to a qualified Owner Move-in to the property. And they could not be evicted for nuisance, or unauthorized occupants or pets. 

Which resident protections will continue indefinitely? 

Although the Los Angeles Board of Supervisors set significant parts of the Resolution to expire, there are still key protections that will extend for residential tenants who benefited from the County’s non-payment of rent protections in the latter half of 2022. Specifically: 

Residents cannot be displaced for No-Fault eviction reasons, except for qualified Owner Move-in Evictions. This means owners may only be able to evict residents if they plan to move into the property themselves. 

Anti-harassment and retaliation protections are still in place for affected residents.

Many Belong homeowners in Los Angeles County have expressed frustration and confusion over the frequent changes, but we’re here to help. While LA homeowners may soon be able to raise rents or evict problematic tenants, there are still fundamental protections in place that all homeowners should understand: 

1. Landlords must follow all local and state laws. Landlords are required to follow all local and state laws related to evictions, including any requirements for notice periods and procedures for eviction. 2. Tenants may be protected by other laws: In addition to the protections provided by the eviction moratorium, tenants may also be protected by other laws, such as the state's regular rent control laws or the federal CARES Act. Landlords should be familiar with these laws and how they may apply to their rental properties. You can find a list of the emergency rental assistance programs available by state here. 

3. Tenants must pay back rent eventually: While tenants have been protected from eviction for non-payment of rent due to COVID-related hardship, they will eventually be required to pay back the unpaid rent. Landlords can request a repayment plan or seek other remedies through the courts.Tenants who have not paid due to COVID hardships have a grace period to pay back rent owed: 

Rent owed from March 1, 2020 to September 30, 2021, tenants must pay by August 1, 2023.

Rent owed from October 1, 2021 to January 31, 2023, tenants must pay by February 1, 2024.

Homeowners spent more on home remodeling projects in 2021 than in the previous four years—20% more, spending a total of $624 billion in 2020 and 2021 combined. Motivated by increased time at home, Americans tackled 134 million renovation projects, crossing off some indefinitely postponed projects at the bottom of the to-do list.

 While some industries took huge financial hits or even disappeared entirely during the global pandemic, home improvement companies thrived. Hobbies replaced vacations and social events, and novices tried baking sourdough, gardening, and home organizing. Those pesky idiosyncrasies of our homes that we used to live with suddenly became intolerable problems.

Belong, a property management alternative, used 2021 American Housing Survey data from the Census Bureau to find the 12 most popular home improvement projects. Rankings were based on the number of projects completed by U.S. homeowners over the past two years. The analysis also includes estimated costs, individually and nationally, which do not affect the ranking. Renovations (which involve moving, adding, or removing walls) are counted separately from remodels (which don't include structural changes).

#12. Driveway or walkway addition or replacement

Repairing or adding a driveway or walkway is one of the more expensive options among the most common home improvements, with an average cost of $4,336. Americans spent $19.5 billion on almost 5 million projects in the past two years. Homeowners may only break even making this investment, but not fixing an old or broken driveway or walkway decreases curb appeal and potential income.

#11. Electrical wiring, fuse box, or breaker switch addition or replacement

Updating a home's electrical wiring can be pricey, depending on the needed improvements. In the past two years, Americans spent an average of almost $2,000 on 5.6 billion electrical remodeling projects—totaling $10.3 billion nationwide. Electrical improvements to fuse boxes or breaker switches can be dangerous, and some states require permits to ensure building and safety codes are met. Consulting with a professional electrician could be worth the money, even for the bravest DIYer.

Repairing or adding fencing keeps children and pets safe while adding an element of privacy. This remodeling project also appeals to renters with pets. Average fencing improvements cost almost $3,000, and people spent $16.2 billion on an estimated 5.7 million projects. Many homeowners consider fence repair and installation a DIY project.

Remodeling the bathroom is one of the top improvements to increase home value and rental income. With an average of $7,636 per remodel, the Census Bureau estimates people spent $51 billion on 6.7 million projects. Both renters and buyers prioritize updated bathrooms, which can make this investment worth it.

#7. Landscaping or sprinkler system addition/replacement

Gardening became a big hobby during the pandemic downtime, and landscaping or adding sprinkler systems has accounted for 7.6 million remodeling projects. With an average cost of $2,778 per remodel, national expenditures exceeded $20 billion during the last two years.

For landlords, installing a sprinkler system and securing landscaping services—whether through a property management company or on your own—reduces maintenance headaches and improves curb appeal.

Roof replacement is the most expensive project on our list, and 7.6 million American households took on roofing jobs, spending almost $10,000 on average per project. Homeowners often wait until roofs incur weather-related damage covered by insurance. A deductible is usually easier on the wallet than paying out of pocket. Still, a roof that is 25 to 30 years old—no matter the condition—makes finding insurance harder and costlier. Energy-efficient improvements qualify for tax rebates, and incentives offered by the Department of Energy and regional power companies can help take the edge off the price tag.

The return on investment in fancy faucets may not be reflected in the bottom line, but the increased demand from potential buyers and renters is worth it. Keeping plumbing up to code is a must, especially in older homes with old drains and pipes.

#3. Flooring, carpeting, paneling, or ceiling tile replacement

Maybe nothing can change a home's look more than new flooring, fresh wall treatments, and a smooth ceiling. Despite the $3,696 average price tag, people spent over $40 million on 1.2 million remodels. DIYers can get a lot of bang for their buck with today's new flooring options and easy-to-install drywall.

The Census Bureau estimates people replaced or added 11.3 million heating and cooling systems in the past two years. With a hefty $5,334 sticker price, a new HVAC system can break the budget, but Americans spent more than $56 billion on 11.3 million units. Taking the "if it ain't broke don't fix it" adage to heart, most people update HVAC systems only when they fail. Energy efficiency subsidies can help offset what is often an unexpected expense at the worst possible time.

Is a recession good for home buyers and real estate investors?

If you’re considering acquiring a home during a recession to take advantage of lowering house prices, it’s worth taking a close look at your finances and employment situation to be prepared before taking on the risk of a new mortgage. There are also current issues of high inflation and rising interest rates that could be a bigger risk to mortgages than the recession itself.  

At a recent webinar on the housing market, our resident Asset Manager, Jon Martin from JDM Asset Management, was asked to weigh in on the topic of acquiring a home with interest rates on the rise. 

“At higher interest rates, fewer prospective homebuyers will qualify for mortgages (or at a lesser dollar amount) and will instead choose to keep renting. Rising rental demand will further push rents up – we’re actually already seeing that, with median nationwide rent passing $2,000 for the first time ever in May 2022,” explains Jon. 

If you are looking at acquiring a property for rent, Jon notes that now is a good time to keep a watchful eye for opportunities and price-drops in your desired neighborhoods, as less competition provides some welcome relief to house hunters. 

“While you’ll have to factor in a higher cost of capital when analyzing your next opportunity, the recent upward pressures on rents and the likelihood of locating an attractive single family rental are creating a more attractive market for acquisitions,” says Jon. 

“Another point to consider when looking to acquire a rental, for those sitting on cash, is a higher down payment than say the standard 20% to reduce your exposure to higher interest rates,” he adds. “This will only help when running the numbers to see if your rental income will cover your operating expenses and mortgage payments,” says Jon.

During a recession and with the high rate of inflation, cash on hand becomes increasingly important. So while it’s a good idea to clear off high-interest debt such as credit cards or personal finance loans, you don’t want to pay off the mortgage entirely if it means draining all of your cash reserves.

5 tips on how to find and research reputable home renovation businesses.

How To Choose a Home Remodeling Contractor

Did you know there are more than half a million remodeling businesses to choose from in the US? Of course, this doesn’t mean the choice will be easy. There’s plenty of horror stories out there from people who have chosen the wrong general contractor, so researching trusted companies to get a bid from is a must. 

If you have friends, family or neighbors who have recently renovated their home, word of mouth can be a great place to start for trustworthy contractors in your local area. Ask them who they used, what the process and timing was like, and if they would use them again.

Even with a good referral, it’s always a smart idea to secure more than one bid to weigh up your options and costs. Once you have secured a few bids, try not to look at costs alone. It’s not uncommon for people to go for the lowest price only to be stung with a huge bill when poor work needs to be redone or there are extra fees and costs hidden in the fine print. 

There’s no way of knowing for sure until the job has started if you’ve made the right choice, but here are five ways to feel confident when choosing a home remodeling contractor. 

When you have some contractors completing bids, ask if they can provide references. 

Ask about the jobs they have finished recently and see if you can speak to any of their customers. Do they have before/after photos you can view to see the finished product?

Photos are great, but it’s also important to note that you’re not shopping for the bricks and mortar. When choosing a home remodeling contractor, it’s the professionalism and craftsmanship you need to focus on, so it helps to speak to people who have dealt with the business before. 

Before getting a quote from any contractor, it’s a good idea to check out their website and local review sites such as Google and Yelp to see what people are saying about them and get a feel for their reputation.

References will usually be positive because they are from customers that have been selected by the contractor. Sometimes online reviews can usually paint a more balanced picture. They’re not always the most trustworthy (you don’t always get the full story from strangers online!), but if there’s more positive than negative words being spoken about the company, you can probably rest easy. 

Remodeling projects are rarely straightforward, so you should have an open dialogue with your chosen contractors. Make sure there are no nasty surprises by being really upfront about what you’re looking for and making sure that you and the contractor are on the same page. 

Note what the communication is like when you approach anyone for a quote. Are you greeted with professionalism and in a timely manner? Do they show up when they say they will? Make sure you deal with a company who handles communication well and interacts with integrity. The way they communicate with you is a good indication of what they’ll be like to deal with, so if they aren’t helpful or open to discussion, this could be a red flag. 

One of the most important steps when choosing a home remodeling contractor is to check their credentials such as licensing and insurance. It’s never worth risking your home with an unlicensed tradesperson. 

Make sure any contractor or business you hire is:

Licensed: Are the contractors licensed for the work required and do they hold memberships with the local or national bodies? Do your homework and see what kind of training, qualifications and licenses they hold.
